Condominium Development
Condominium development in Ontario is a complex legal process requiring experienced legal counsel to guide projects from concept to successful sales and registration. At SV Law, our condominium lawyers and law clerks are among the most experienced in Ontario, providing strategic, practical guidance to bring certainty to every stage of development.
We work closely with developers and an established network of trusted professionals, including property managers, surveyors, engineers, urban planners, and architects to support efficient and compliant condominium development across Ontario.

Our team has extensive experience with all condominium types, including standard, common element, vacant land, phased, and leasehold condominiums.
Condominium Management
Recent amendments to the Condominium Act, 1998, and ongoing legislative changes continue to create a complex regulatory environment for condominium corporations. At SV Law, our condominium lawyers provide practical, experienced guidance to boards navigating governance, compliance, and day-to-day operations.
We support condominium corporations with clear, responsive legal advice across all aspects of governance and legislative interpretation, advising all condominium types, including standard, common element, vacant land, phased, and leasehold corporations across Ontario.
- Drafting and amending declarations, descriptions, by-laws, and rules
- Preparing and registering indemnity agreements (bulk and unit-specific)
- Creating standard unit and insurance deductible by-laws
- Drafting governance by-laws, including director qualifications, codes of ethics, and electronic voting/meeting provisions
- Interpreting and advising on shared facility agreements
- Drafting borrowing by-laws and lender communications
- Chairing annual general meetings, special meetings, and owner town halls (in-person and virtual)
- Providing legal opinions on condominium governance and compliance matters
Enforcement & Litigation
Our experienced litigators assist condominium corporations at every stage of enforcement and litigation, including:
- Enforcing declarations, by-laws, and rules (from compliance letters to mediation and arbitration)
- Representing condominiums before the Condominium Authority Tribunal (CAT), including negotiation, mediation, and hearings
- Litigation in Ontario courts, including Small Claims Court and the Superior Court of Justice
- Handling compliance applications and appeals through higher courts where required
Our team brings extensive experience across all levels of Ontario courts, including the Small Claims Court, Superior Court of Justice, Divisional Court, and Court of Appeal.
To support transparency and efficiency in dispute management, our team developed the SV Condominium Authority Tribunal Process Chart, outlining each step in condominium dispute resolution involving declarations, by-laws, rules, and indemnity matters.
Liens & Collections
A condominium’s financial stability depends on the consistent collection of common element fees. Unlike traditional corporations, condominiums are not profit-driven and rely on these fees to maintain services, amenities, and statutory repair obligations under the Condominium Act, 1998.
Our condominium lawyers and clerks provide efficient, technology-supported collection and lien services to protect a condominium’s financial interests and ensure compliance with legislative requirements. We use tools such as our LienRight software to streamline processes and improve recovery outcomes.
- Demand and FIFO letters
- Title and due diligence searches (including matrimonial home designations)
- Preparation and registration of Notices of Lien
- Land Registry Office registrations
- Arrears collection
- Power of sale proceedings
- Discharge of liens
- Communication with owners, boards, and mortgagees
